This is a review of Kazutaka Inamura's book "Justice and Reciprocity in Aristotle's Political Philosophy" (Cambridge University Press, 2017).

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera (...) de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. Convocada por diferentes estudiosos de los Padres de la Iglesia y del cristianismo antiguo en Latinoamérica, a saber, los profesores Ana Cristina Villa Betancourt, Andrés Mauricio Quevedo Rodríguez y Estiven Valencia Marín, de Colombia; Alejandro Nicola y Francisco Basttita-Harriet, de Argentina; Bruno Gripp, de Brasil; Pamela Chávez Aguilar, de Chile; y Jesús Ma. Aguiñaga Fernández, de México.

El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Cet article poursuit un double but : d’une part, situer dans le parcours philosophique de Wittgenstein une partie de l’histoire du « problème du champ visuel », thème clé de sa période intermédiaire ; d’autre part, mettre en lumière sa critique de l’idée d’un champ visuel (et celle de l’idée d’un objet interne). Nous croyons que ses arguments sont nouveaux, pénétrants, et ainsi leur intérêt dépasse les limites d’un exposé purement exégétique.

Le scientisme a plus de notoriété que l’histoire proprement dite, car il a été identifié avec le « positivisme », le « réductionnisme », le « matérialisme » ou le « marxisme », ou même tenu responsable de la domination de la science sur leur autres activités humaines. L’idée que la recherche scientifique produit les meilleures connaissances possible réside dans la définition même du « scientisme ». Cependant, alors même que la science peut se prévaloir d’un nombre considérable de succès (...) théoriques et pratiques, une confiance rationnelle envers elle comme moyen de résoudre tout problème factuel a été dénoncée comme illégitime, discutable ou dogmatique. Ainsi, après avoir passé en revue les diverses conceptions du scientisme, je défends une position raisonnable du scientisme contre certaines de ses critiques dominantes. Ainsi, on soutiendra que la science est l’approche la plus fiable pour acquérir des connaissances sans nuire à d’autres activités importantes dans la mesure où celles-ci ne traitent pas de questions factuelles ou cognitives ni ne sont en contradiction avec une vision du monde scientifique. Fenomenologia della percezione (1ª ed. 1941, 2ª ed. 1961) è, a mio parere, un libro fondamentale, che ci può orientare in modo decisivo davanti alla dialettica idealismo - realismo (60). Infatti, il principio di immanenza, da Cartesio a Gadamer, si basa su una sbagliata e gratuita descrizione del punto di partenza della conoscenza. In questa concezione, la conoscenza partirebbe da una materia informe, o un polverone di elementi che deve essere organizzato in qualche modo dal soggetto. L’esperienza ci dà la (...) molteplicità, e l’unità non può venire che dal soggetto. Ora, qual’è l’esperienza sulla quale si basa questa asseverazione? Nessuna, ovviamente, ed p. Fabro si incarica di provarlo fino alla stanchezza nelle 400 pagine che compongono la sua colossale opera. Il punto di partenza dell’idealismo non è per niente fuori discussione, e per convincersi basta prendere tra le mani questo libro. (shrink)

Dans cet article, il sera fait un bref rappel du modèle traditionnel d’interprétation des lois, toujours prescrit dans la doctrine, sinon épousé verbalement dans les tribunaux canadiens. Il sera démontré que ce modèle ne peut pas représenter toute la réalité du travail d’interprétation des juristes canadiens, pour plusieurs raisons. L’herméneutique, la sociologie critique, l’analyse du discours, prenant pour objet les textes législatifs, les jugements rendus, les arguments pratiques entendus, ont montré l’étendue du comportement réflexif réel, l’étendue du champ interprétatif visant (...) les circonstances d’une cause. Les textes législatifs donnent de fait de plus en plus de place à l’interprétation des circonstances pertinentes à l’encadrement de l’action des justiciables. Sur un plan empirique, l’analyse des jugements, de même que les prises de position de juges lorsqu’ils s’expriment en dehors du forum judiciaire, mettent en évidence la variété des motifs effectivement pris en considération, l’espace considérable de délibération éthique impliquant de fait tous les interprètes, qu’ils soient simples citoyens d’une communauté, inspirés par l’un ou l’autre des ordres sociaux, ou acteurs spécialisés de l’ordre juridique. Cet article se propose d’examiner comment se produit actuellement, en droit canadien ou québécois, l’interprétation des juristes, dans des processus décisionnels réflexifs, en situations complexes, voire même dans la perspective du développement des institutions. In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. What is at stake is the nature of our society. Do we want an expertocracy, in which an enlightened few design policies for the greater good of the majority and exploit the lack of public knowledge to achieve compliance? (shrink)

I argue that rather than dismiss Foucault’s first book, Mental Illness and Personality, as an “apologetic exposition of Pavlov’s reflexology,” we ought see it as a valuable source documenting Foucault’s change of attitude towards psychology and the history of science in the early 1950s. I argue that there are two distinguishable strands that make up the text. The ‘frame’ of the book—the introduction, first chapter of the second part and conclusion of the book—is expressive of a critical attitude towards psychology, (...) and indicative of rather sophisticated conception of the history of science as a critical history aimed at bringing into view the unscientific forces that shape scientific labor. The ‘main body’ of the text—the first part and the second chapter of the second part—by contrast, reads as the history of the steady dialectical progress of the psychological sciences towards an ever more accurate understanding of mental illness. It is thus indicative to a naïve approach to psychology and to its history. The tension between the two strands of the book thus documents the starting point of Foucault’s then shifting attitudes toward the psychological sciences and the history of science, and the set of questions and sources that lead him to problematize his understanding of and approach to the latter. Les savoirs de sens commun sont solidement ancrés dans les usages, notamment grâce à l’habitude et à la sécurité ontologique qu’ils engendrent. Cet article examinera d’abord pourquoi les savoirs disciplinaires appris à l’école ne sont pas automatiquement réinvestis dans des contextes de nature extrascolaire et pourquoi les savoirs de sens commun résistent à leur déconstruction. La première partie de l’analyse sera marquée par le croisement de discours épistémologiques concernant la nature et la place des savoirs de sens commun dans les (...) conceptions familières de la science. Cet article explorera ensuite les dynamiques qui marquent les relations qu’entretiennent les savoirs disciplinaires scolaires et les savoirs de sens commun en contexte scolaire. Le langage propre à la seconde partie se rattachera davantage aux débats en éducation sur l’importance prépondérante des savoirs de sens commun dans l’apprentissage disciplinaire par concepts. Enfin, nous montrerons qu’il existe des stratégies d’enseignement qui peuvent optimiser l’appropriation intellectuelle des savoirs disciplinaires scolaires et leur transfert dans les interactions quotidiennes. Oliver's and Rodriguez-Pereyra's important interpretation of the problem of universals as one concerning truthmakers neglects something crucial: that there is a numerical identity between numerically distinct particulars. The problem of universals is rather how to resolve the apparent contradiction that the same things are both numerically distinct and numerically identical. Baxter's account of instantiation as partial identity resolves the apparent contradiction. A seeming objection to this account is that it appears to make instantiation symmetric, since partial identity is symmetric. Armstrong's (...) standard reply is that the difference between a particular and a universal is what makes instantiation asymmetric. Brown suggests, though, that the instantiation of a universal by a universal is sometimes symmetric. However, the examples on which he relies are not universals. (shrink)

ABSTRACT An apparent objection against my theory of instantiation as partial identity is that identity is necessary, yet instantiation is often contingent. To rebut the objection, I show how it can make sense that identity is contingent. I begin by showing how it can make sense that identity is temporary. I rely heavily on Andre Gallois’s formal theory of occasional identity, but argue that there is a gap in his explanation of how his formalisms make sense that needs to be (...) filled by appeal to my theory of Aspects. Among others, the recent work of Janine Idziak presents Andrew of Neufchateau (†1400) as a fervent advocate of “divine command ethics,” a promoter of radical voluntarism, according to which moral values depend solely on the divine will. One example that illustrates this theory is the “hatred of God” (odium Dei ), often discussed in the fourteenth century. Since moral values depend on the divine will, it can be morally good to hate God if that is his command. Andrew has been (...) seen and is still seen today as a supporter of this view. Si le bonheur exige la solitude, il est toujours hanté par l’altérité ; si sa source est en soi-même, il ne cesse toutefois de dépendre de circonstances contingentes ; et si, enfin, il s’éprouve tout entier dans le sentiment, il s’agit pourtant d’un sentiment augmenté d’un caractère réfléchi ou, pour mieux (...) dire, redoublé dans le souvenir que retrace l’écriture. Dans tous les cas, ces antinomies du bonheur – sur lesquelles nous reviendrons longuement plus loin – s’enracinent dans une marqueterie de références dont l’hétérogénéité est l’expression d’un dialogue tendu au sein duquel, comme nous souhaiterions d’abord le montrer, la philosophie morale des Anciens se réinvente en adoptant le langage, éminemment moderne, du sentiment. NUTRIÇÃO SOBRE AS FALHAS REPRODUTIVAS DOS BOVINOS -/- E. I. C. da Silva Departamento de Agropecuária – IFPE Campus Belo Jardim Departamento de Zootecnia – UFRPE sede -/- -/- FALHAS REPRODUTIVAS DE BOVINOS -/- INTRODUÇÃO -/- Os bovinos, assim como tantos outros mamíferos e demais espécies, podem sofrer distúrbios durante o ciclo reprodutivo. Transtornos, alterações ou patogenias afetam diretamente a saúde do sistema reprodutor desses animais. As causas podem ser individuais ou multifatoriais, de caráter parasitário, patogênico, climático, nutricional etc. As (...) causas de caráter parasitário podem ser controladas mediante a assepsia e profilaxia para a eliminação dos parasitas como carrapatos que vivem no mesmo habitat que o animal. As de caráter patogênico, como estão relacionadas à doenças, necessitam de especialistas na área, como o médico-veterinário para a avaliação, diagnóstico e tratamento por meio de práticas cirúrgicas ou na administração de fármacos. O fator clima pode ser controlado mediante o investimento em tecnologia e aquisição de equipamentos que possam manter a integridade e o bem-estar do animal, seja por ventiladores, exaustores, nebulizadores, aspersores, etc. Por fim, as de caráter nutricional podem ser prevenidas mediante a boa administração energética, proteica e mineral, além de uma boa qualidade de alimento volumoso ou concentrado que atenda e supra os requerimentos exigidos por cada categoria animal. Sendo assim, pode-se dividir as falhas reprodutivas dos machos bovinos relacionados à nutrição em energia, proteína, minerais e vitaminas. Antes disso, essas falhas estão relacionadas aos fatores de degeneração testicular e casos de hipospermia. -/- 17.1 Degeneração testicular e Hipospermia -/- Degeneração testicular é uma importante causa de infertilidade em machos de todas as espécies. Entre as causas, podem ser consideradas a elevação da temperatura testicular (por isso torna-se importante que a bolsa escrotal tenha um certo tamanho que permita aos testículos ficarem longe do corpo, uma vez que a temperatura corporal mataria os espermatozoides, sendo essencial os testículos ficarem “caídos” para que possam ter no mínimo 2-3 °C à mesmos do que a temperatura corporal), infecções, fatores nutricionais, lesões vasculares, lesões obstrutivas etc. O testículo com degeneração mostra diminuição de tamanho, fibrose, alterações na espermatogênese, aumento de esperma imaturo ou anormal e azoospermia em casos severos. -/- Em casos de lesão testicular com dano parcial sobre o epitélio germinal, apresenta-se uma menor taxa de formação e maturação das células espermáticas. O macho pode ser fértil, mas a condição de hipospermia levará à que, sob condições de estresse ou alta carga de fêmeas a cobrir, se apresentem falhas na fertilização. Ejaculados com características de hipospermia não podem ser congelados, logo não servem para a indústria do sêmen. -/- -/- Deficiências nutricionais retardam o início da puberdade e deprimem a produção e as características do sêmen. Os efeitos da má nutrição podem ser corrigidos em animais maduros, enquanto que é menos bem sucedido em animais jovens devido aos danos permanentes causados no epitélio germinal do testículo. (FRAZER, 2005; GORDON, 1996). Entre as principais limitantes de origem nutricional temos: -/- 17.2 Vitaminas -/- 17.2.1 Vitamina A -/- A deficiência de vitamina A e provitamina A (já que é essencial direta ou indiretamente para a função de todos os órgãos e particularmente para o crescimento e desenvolvimento dos epitélios) é necessária para a diferenciação celular, processo no qual se modificam as células não especializadas de modo que possam realizar funções específicas. Os órgãos reprodutores exigem retinol para que possam realizar o processo de espermatogênese normal nos machos e para prevenir a necrose placentária e a mortalidade fetal na fêmea. Carências de Vitamina A produzem: degeneração do epitélio germinal, baixa espermiogênese parcial ou total, cornificação do epitélio vaginal, irregularidades do estro, atrasos na concepção, abortos, crias fracas e/ou deficientes visuais (cegas) e uma degeneração da placenta e a retenção da mesma. A deficiência da vitamina A pode conduzir a uma degeneração dos tubos seminíferos nos bovinos jovens e deve-se ao fato da supressão da liberação de gonadotropinas hipofisárias e noutros casos, a espermatogênese é impedida e as funções das células de Sertoli e de Leydig são alteradas. A vitamina A não é sintetizada no organismo, o que leva a uma dependência direta do fornecimento dessa vitamina através dos alimentos que o criador têm na propriedade, seja forragens ou concentrados de ótima qualidade. -/- Essa vitamina é essencial para os animais e humanos, visto que participa de inúmeras funções metabólicas no corpo dos mesmos. Sendo assim, o criador deve saber das exigências vitamínicas do seu rebanho. Em bovinos de corte a exigência e a recomendação de fornecimento dessa vitamina está entre 2200 UI/kg de MS para animais em crescimento e engorda e para reprodutores recomenda-se níveis de 3900 UI/kg de MS. Já para bovinos leiteiros esses números são diferentes, de acordo com livros de nutrição de ruminantes, animais em crescimento e engorda devem consumir matéria seca com teores de 80 UI/kg de MS, já para reprodutores e animais adultos a quantidade recomendada e exigida é de 110 UI/kg de MS, isso diariamente. As forragens suprem bem a exigência de vitamina A dos animais, em especial o capim tifton e o tanzânia são os mais recomendados uma vez que possuem altos teores vitamínicos e minerais. As vias de suplementação dessa vitamina é através das forragens (mais acessível e barato), através da ração concentrada ou pela água e suplementação injetável. -/- 17.2.2 Vitamina E -/- A vitamina E é uma substância também conhecida como tocoferol, sendo sua forma mais ativa o alfa tocoferol. A vitamina E pertence ao grupo de vitaminas lipossolúveis amplamente distribuídas nos alimentos. -/- A sua principal função é descrita como um antioxidante natural, agindo como tal, a vitamina E evita a oxidação de constituintes celulares essenciais e/ou evita a formação de produtos tóxicos de oxidação, como os produtos de peroxidação formados a partir de ácidos graxos insaturados que foram detectados através de sua ausência. Essa vitamina é essencial para a reprodução normal em várias espécies de mamíferos. Ela ainda têm sido usada em clínicas reprodutivas de todo o mundo para o tratamento de abortos recorrentes e da infertilidade em ambos os sexos (CHAN, 2003). -/- -/- A deficiência da vitamina E influencia a maturação espermática e a degeneração do epitélio germinal dos túbulos seminíferos, já que ela os protege da oxidação evitando a deterioração da peroxidase sobre os fosfolipídios poli-insaturados da membrana espermática (PITA RODRÍGUEZ, 1997). A deficiência dessa também evita o crescimento anormal. Na ausência de vitamina E, a quantidade de gorduras insaturadas dentro das células diminuem, causando anomalias estruturais e funcionais das organelas mitocondriais, lisossomos e até mesmo na membrana celular, se essa falta de vitamina E no adulto tornar-se acentuada ocorrerá a degeneração precoce do epitélio germinal, o que afeta, em primeiro lugar, as células mais evoluídas: os espermatozoides, cuja mobilidade se perde e sua formação torne-se cada vez mais rara, até chegar ao nível de esterilidade completa. -/- As exigências dos bovinos de corte quanto a vitamina em questão é de 15 – 60 UI/kg de MS diárias para animais em crescimento e engorda. Já para bovinos leiteiros, essa exigência é muito menor chegando a 0,8 UI/kg de peso vivo (PV) para animais em crescimento e engorda e para animais adultos e reprodutores cerca de 1,6 UI/kg de PV diários. Os alimentos, assim como as vias de suplementação ideais, são os mesmos mencionados no tópico acerca da vitamina A. -/- 17.3 Proteínas -/- O efeito do excesso de proteína da dieta na reprodução é complexo. Os excessos de proteína podem também ter um efeito negativo na reprodução. Alguns efeitos foram demonstrados para explicar o pobre desempenho reprodutivo que algumas vezes é observado em dietas com excessivos níveis de proteína: Podem apresentar-se altos níveis de ureia no sangue, o que possui efeito tóxico sobre os espermatozoides, óvulos, e o embrião em desenvolvimento (WATTIAUX, 1990), igualmente, apresenta-se um desequilíbrio energético que em casos severos bloqueia a liberação de LH produzindo alteração na maturação espermática nas células de Leyding. -/- As proteínas são importantes para todo o funcionamento normal e funções fisiológicas e metabólicas dos animais e do homem. Logo, a tabela 1 traz os níveis recomendados e exigências de bovinos de corte de diferentes categorias para que se possa prevenir e/ou combater as possíveis degenerações testiculares bem como a hipospermia, trazendo os requerimentos de bovinos leiteiros jovens o que é mais ideal para combater previamente esses distúrbios que afetam diretamente a função reprodutiva e o desemprenho dos animais. -/- Tabela 1: Exigências de proteína metabolizável (PM) e proteína bruta (PB), para diferentes categorias de bovinos de corte -/- BAIXE O PDF E VISUALIZE A TABELA -/- Para os bovinos leiteiros jovens, os níveis de PB presente na dieta dos animais entre 150 e 400 kg de PV podem ser entre 12 e 22%, o que é ideal para a prevenção de degenerações, atraso à puberdade ou qualquer anormalidade que afete o desempenho dos animais. -/- Os alimentos mais proteicos são os de origem animal, porém não se pode ofertá-los completamente e diretamente aos animais, isto é, deve-se misturá-los a outros ingredientes; logo, o tipo e a quantidade de proteína depende dos ingredientes, do método de alimentação e do potencial produtivo e genético dos animais. -/- 17.4 Minerais -/- 17.4.1 Manganês (Mn) -/- O manganês é um componente de várias enzimas e essencial para a estrutura óssea normal. Quando a alimentação é deficiente em Mn por algumas semanas, o corpo parece conservar este mineral de forma eficaz. -/- Numa dieta média, cerca de 45% do mineral ingerido é absorvido. A absorção pode ser diminuída com o consumo de quantidades excessivas de Ca, P ou Fe. Após a absorção, o Mn liga-se à sua proteína transportadora e é conhecido como transmanganina. Os ossos, e em menor quantidade o fígado, músculos, e pele servem como locais de armazenamento desse mineral. -/- O Mn está envolvido na função pancreática e na utilização correta da glicose, sendo também um interveniente ativo na produção de tiroxina e de hormonas sexuais. Tem importância na produção do colesterol e no metabolismo de gorduras. -/- O Mn é um mineral de grande afinidade com o aparelho reprodutor. A deficiência desse elemento produz uma diminuição da fertilidade, atraso no desenvolvimento testicular e diminuição da espermatogênese. Se houver atrofia dos testículos, a produção de espermatozoides será reduzida e, portanto, a fertilidade será afetada. -/- A quantidade de 13 mg de Mn por kg de MS é suficiente para a obtenção de um crescimento adequado, mas para um crescimento testicular ideal e constante é necessário um mínimo de 16 mg de Mn por kg de MS. -/- Para uma boa suplementação que atenda às necessidades do gado de corte e leite, o nível ideal de Mn presente na MS em mg/kg deve estar entre 12 – 18 para os bovinos leiteiros e entre 20 – 50 para o gado de corte, tendo como recomendação ideal cerca de 40 mg/kg de MS diários para ambos. Esse mineral pode estar presente tanto na água quanto nas plantas presentes no pasto, portanto a suplementação natural é a melhor escolha, caso necessário a suplementação artificial através da ração no cocho ou do sistema SMI é recomendada. -/- 17.4.2 Iodo (I) -/- A deficiência de I também ocasionar dificuldades reprodutivas e hipospermia. Só a captação da tiroide responde à TSH, e somente a glândula endócrina tiroide incorpora esse elemento nos hormônios que são por ela elaborados. Assim, mais de 90% do iodo do organismo é encontrado nas glândulas tireóideas, principalmente como iodo orgânico. Este grande acúmulo de I na glândula é trocado muito lentamente, cerca de 1% por dia. -/- O I entra no organismo via oral e sob a forma de íon iodeto, absorvendo-se muito facilmente desde o aparelho digestivo e passando rapidamente à corrente circulatória e, posteriormente à glândula tiroide (ALBARRACÍN, 2005) onde tem que vencer um gradiente de concentração de 1 a 20; todavia, dada a afinidade entre essa glândula e o iodo, não existe nenhum problema na organização. Na célula folicular, através da ação da peroxidase, converte-se em I molecular que passa para o coloide para se ligar à tiroglobulina e formar as hormonas tireóideas. -/- O I pode atuar sobre o aparelho genital diretamente ou através da hipófise. A tiroidectomia reduz a produção espermática, por sua vez a tiroxina exótica pode restaurá-la. Essa última, administrada dentro de seus limites fisiológicos, aumenta a produção espermática ao incrementar o metabolismo geral. Talvez, o mecanismo mais aceito para atingir esta função fisiológica seja a regulação do consumo de oxigênio pelas células espermáticas. -/- O I pode ser fornecido em quantidades entre 0,2 e 1,0 mg/kg de MS para todas as categorias animais e sem que o produtor possa se preocupar. O I, que é de suma importância, encontra-se na água e nos vegetais, porém pode ser incrementado via alimentação concentrada ou através da injeção mineral direta no animal. -/- 17.5 Energia -/- A disponibilidade de energia está diretamente relacionada com o padrão normal de pulsatilidade do LH. No caso do balanço energético negativo (BEN), verifica-se um rápido aumento da utilização de glicose, resultando em hipoglicemia e, por conseguinte, hipoinsulinemia que, como se sabe, conduz rapidamente a uma lipólise com maior disponibilidade de ácidos para oxidação. Por sua vez, a síntese de colesterol precursor de esteroides sexuais é diminuída. A alteração da relação estrogênios- androgênios no macho causa uma expressão pobre da libido ou desejo sexual. -/- No touro a subnutrição afeta intensamente a função secretora das glândulas acessórias, provocando uma diminuição de 30 a 60% nas concentrações de frutose e ácido láctico do esperma. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Una opción para leer a Žižek en función de sus incesantes desplazamientos, comenzando por el más fundamental: la paralaje entre lectura y escritura. (shrink)

In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. St. Thomas Aquinas has always considered intelligence a potency higher than the will, absolutely speaking. That being said, and in my view, the existential primacy of the will in the act of freedom (particularly in choosing the existential end) is also indisputably Thomistic, as Cornelio Fabro has shown. This paper endeavors to explain Aquinas' doctrine on the absolute primacy of the intellect and thus show that these two primacies can be affirmed coherently, that is, the intellect’s absolute primacy and the (...) will’s existential primacy. Firstly, I will explain the reasoning St. Thomas Aquinas uses in the Summa to justify the absolute primacy of the intellect over the will. Secondly, I will explore some parallel texts, in order to shed light on my interpretation of the Summa and expand our view regarding this and related doctrinal points. Thirdly, I will offer a brief study of Fabro’s position, one in which his concerns regarding the intellect’s absolute primacy are taken into account and carefully considered. (shrink)

In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. The paper clarifies the sense of remark 202 of Wittgenstein's *Philosophical Investigations* with respect to its relation to the private language argument. It argues, against what some have maintained, that remark 202 is not meant to reject the possibility of a private language as this is defined in remark 243.

This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. Why I thought it useful to offer an explanation of Hegel’s doctrine on the Incarnation was so that the reader may be empowered to identify Hegel’s influence in modern accounts of this mystery. Even if, in my view, Hegel’s interpretation of revealed religion differs greatly from Catholic Doctrine, it is not surprising to find the presence of some of his concepts in modern theology. In truth, what matters is not the theologian’s self-identification as Hegelian or as non-Hegelian, but whether or (...) not the theologian adopts Hegel’s concepts. This paper offers an explanation of the internal dynamism of Hegelian concepts and their relation to Christian doctrine in Hegel’s Phenomenology of Spirit. This research may help to show in what way it is possible to explain Christian religious doctrine with a philosophy other than the Thomistic one and how, at least in Hegel’s case, religious doctrine is changed and reduced to an erroneous philosophical content. Also, an attempt is made to show the internal “coherence” of this Hegelian re-reading of Christianity so that theologians may become more cautious about accepting an explanation of Christian doctrine simply because the Christian language is preserved in that explanation. There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

The fact that names refer to individuals is a basic assumption of referentialist theories of proper names, but the notion of individual is systematically taken for granted in those theories. The present paper follows that basic assumption, but proposes to analyze the notion of individual prior to the development of any semantic theory of proper names. It will be argued that a particular perdurantist conception of individual should be adopted, which distinguishes the notions of individual occurrence, and individual simpliciter. A (...) new theory of proper names (called the cluster-occurrence theory) is presented, according to which names refer to individual occurrences, and the intension associated with a name is an individual simpliciter. The merits of the new theory are then assessed in confrontation with its standard rival accounts. (shrink)

Not even Quine considers figurative speech committal, so this turns the tables somewhat. In the first section I set out what I take that distinction, as Carnap draws it, to be, and spell out a central motivation Carnap has for invoking it. In the second section I endorse, and augment, Yablo's response to Quine's arguments against Carnap. In the third section I say why Carnap's application of the distinction between internal and external questions runs into trouble. The following is an interpretation of Aquinas’ agent intellect focusing on Summa Theologiae I, qq. 75-89, and proposing that the agent intellect is a metaphysical rather than a formal a priori of human understanding. A formal a priori is responsible for the intelligibility as content of the object of human understanding and is related to Kant’s epistemological views; whereas a metaphysical a priori is responsible for intelligibility as mode of being of this same object. We can find in Aquinas’ text (...) many indications that the agent intellect is not productive of the universal as content but is, rather, productive of the abstracted or intelligible mode of being of the universal nature. This is because for Aquinas the universal nature, which is the object of human understanding, is present in the things themselves but with a different mode of being. Chapter 1 is intended to establish the fact which requires for Aquinas an agent intellect, and provides two very important principles: one is that the object of human understanding (the universal nature) is present in the things themselves and, the other, that it is not in the things themselves with a mode of being which makes it available to the intellectual eye. These two principles lead us to the main point of Chapter 2, namely the distinction between the intelligible object and its intelligible mode of being. Now, because knowing is receptive of the intelligible object (Chapter 3), which is present in the things themselves (Chapter 1), the agent intellect is productive not of the object’s intelligible content, but of its abstracted or intelligible mode of being (Chapter 4). In a recent paper, Erasmus et al. (2021) defend the idea that the ambiguity of the term “explanation” in explainable AI (XAI) can be solved by adopting any of four different extant accounts of explanation in the philosophy of science: the Deductive Nomological, Inductive Statistical, Causal Mechanical, and New Mechanist models. In this chapter, I show that the authors’ claim that these accounts can be applied to deep neural networks as they would to any natural phenomenon is mistaken. I also (...) provide a more general argument as to why the notion of explainability as it is currently used in the XAI literature bears little resemblance to the traditional concept of scientific explanation. It would be more fruitful to use the label “understandable AI” to avoid the confusion that surrounds the goal and purposes of XAI. In the second half of the chapter, I argue for a pragmatic conception of understanding that is better suited to play the central role attributed to explanation in XAI. Following De Regt (2017) and Kuorikoski and Ylikoski (2015), the conditions of satisfaction for understanding an ML system are fleshed out in terms of an agent’s success in using the system. Vision is an important metaphor in ethical and political questions of knowledge. The feminist philosopher Donna Haraway points out the “perverse” nature of an intrusive, alienating, all-seeing vision (to which we might cry out “stop looking at me!”), but also encourages us to embrace the embodied nature of sight and its promises for genuinely situated knowledge. Current technologies of machine vision – surveillance cameras, drones (for war or recreation), iPhone cameras – are usually construed as instances of the former rather (...) than the latter, and for good reasons. However, although in no way attempting to diminish the real suffering these technologies have brought about in the world, I make the case for understanding technologies of computer vision as material instances of embodied seeing and situated knowing. Furthermore, borrowing from Iris Murdoch’s concept of moral vision, I suggest that these technologies direct our labor towards self-reflection in ethically significant ways. My approach draws upon paradigms in computer vision research, phenomenology, and feminist epistemology. Ultimately, this essay is an argument for directing more philosophical attention from merely criticizing technologies of vision as ethically deficient towards embracing them as complex, methodologically and epistemologically important objects. : New genetic technologies continue to emerge that allow us to control the genetic endowment of future children. Increasingly the claim is made that it is morally "irresponsible" for parents to fail to use such technologies when they know their possible children are at risk for a serious genetic disorder. We believe such charges are often unwarranted. Our goal in this article is to offer a careful conceptual analysis of the language of irresponsibility in an effort to encourage more care (...) in its use. Two of our more important sub-claims are: A fair judgment of genetic irresponsibility necessarily requires a thick background description of the specific reproductive choice; and there is no necessary connection between an act's being morally wrong and its being irresponsible. La compresión posee una estructura dialéctica que implica la cancelación de las propias expectativas y el acceso a un saber más abarcante. Aunque (...) la comprensión es histórica, en ella se muestra cada vez un aspecto de la cosa misma, que resulta de la interacción del yo y el tú en el curso de la conversación hermenéutica y que constituye una verdad común con caracteres análogos a los del saber de tipo práctico. [The paper exposes the role of the other in Gadamer’s hermeneutics in the light of the idea of dialogue. Understanding requires the recognition of the other as a thou, the acceptance of the lack of distance from him and the openness to embrace what is said by him as a possible truth. Understanding has a dialectical structure which implies the cancellation of one’s own expectations and the access to a more comprehensive knowledge. Even though every understanding is historical, it discloses an aspect of the thing itself, which results from the interaction of the I and the thou during the process of hermeneutical conversation and constitutes a common truth with analogous characteristics to practical reason.] . Unlike other classical arguments for the existence of God, Pascal’s Wager provides a pragmatic rationale for theistic belief. Its most popular version says that it is rationally mandatory to choose a way of life that seeks to cultivate belief in God because this is the option of maximum expected utility. Despite its initial attractiveness, this long-standing argument has been subject to various criticisms by many philosophers. What is less discussed, however, is the rationality of this choice in situations where the (...) decision-makers are confronted with greater uncertainty. In this paper, I examine the imprecise version of Pascal’s Wager: those scenarios where an agent’s credence that God exists is imprecise or vague rather than precise. After introducing some technical background on imprecise probabilities, I apply five different principles for decision-making to two cases of state uncertainty. In the final part of the paper, I argue that it is not rationally permitted to include zero as the lower probability of God’s existence. Although the conditions for what makes an act uniquely optimal vary significantly across those principles, I also show how the option of wagering for God can defeat any mixed strategy under two distinct interpretations of salvation.
